Terms of Use

These Terms of Use (the "Terms") set out the conditions for use of the website for "Shu-kaji Taketomi Island Sabani Tours" (the "Site") operated by Maruhachi Shokusan Co., Ltd. (the "Company"), and of the tours, experience services, photo/video options, reservation handling, inquiry response and other related services provided through the Site (collectively, the "Services").

All persons who use the Services ("Users") shall do so after agreeing to these Terms.

Article 1 (Application)

These Terms apply to all relationships between Users and the Company concerning use of the Services.

In addition to these Terms, the Company may post its Cancellation Policy, Privacy Policy, Legal Notice under the Act on Specified Commercial Transactions, individual product pages, information provided at the time of booking, and other individual provisions set out on the Site ("Individual Provisions").

Individual Provisions form part of these Terms; where the content of these Terms and any Individual Provision differ, the Individual Provision shall prevail.

Article 2 (Definitions)

The terms used in these Terms are defined as follows.

  • "User" means any person who browses the Site, makes a reservation request, makes a purchase, submits an inquiry, or otherwise uses the Services.
  • "Services" means the sabani tours, island walking experiences, photo/video options and related services provided by the Company, together with the associated reservation handling, guidance, inquiry response and the like.
  • "Content" means all text, images, video, audio, logos, designs, programs and any other information provided on the Site.
  • "Reservation Request" means an expression by a User, through the method prescribed by the Company, of the intention to use the Services.

Article 3 (Amendment of These Terms)

The Company may amend these Terms without prior notice to Users when it deems necessary.

The amended Terms shall take effect from the time they are posted on the Site.

A User who uses the Services after such amendment shall be deemed to have agreed to the amended Terms.

Article 4 (Usage Environment)

Users shall prepare, at their own expense and responsibility, the communication equipment, smartphones, computers, software, communication lines and other environment necessary to use the Services.

The Company shall bear no liability where a User is unable to use the Services due to their communication or device environment, failures of external services, or other circumstances on the User's side.

Article 5 (Reservation Requests and Formation of Contract)

Users shall submit Reservation Requests or inquiries for the Services through the method prescribed by the Company.

A contract for use of the Services shall be formed when the Company accepts the User's request and sends a booking confirmation.

The Company may decline a request due to weather, sea conditions, safety judgments, booking availability, the content of the request, or other circumstances.

Tour times, meeting times, meeting points and other details may be adjusted according to booking availability, tide levels, weather and other circumstances.

Article 6 (Fees and Payment)

Fees for the Services shall be the amounts displayed on the Site, individual product pages, the booking system, or the information provided at the time of booking.

Users shall select a payment method from cash, credit card, or other electronic payment, within the range of methods supported by the Company.

The timing of payment varies by product, booking method and selected payment method, and shall be either advance payment or on-site payment on the day the service is provided. Details are as set out on each product page or in the information provided at the time of booking.

Bank transfer fees, communication charges and other costs incidental to payment shall be borne by the User.

If a User delays payment, the Company may cancel the reservation, suspend provision of the Services, or take other necessary measures.

Article 7 (Cancellations and Changes)

Cancellations or changes at the User's request shall be governed by the Cancellation Policy separately set out by the Company, the Legal Notice under the Act on Specified Commercial Transactions, the relevant product page, or the information provided at the time of booking.

Where provision of the Services becomes difficult due to causes attributable to the User, such as illness, being under the influence of alcohol, late arrival at the meeting point, or inability to make contact, the Company may treat such cases in accordance with the preceding paragraph.

Handling of sudden circumstances or other unavoidable causes shall be determined by the Company on a case-by-case basis after reviewing the circumstances.

Article 8 (Cancellation by the Company and Changes to Content)

The Services may be cancelled, postponed, or changed in content or itinerary due to weather, sea conditions, tide levels, wind speed, weather warnings or advisories, safety standards, local conditions, or other circumstances.

Where the Company judges it necessary to ensure the safety of Users or guides, it may cancel or change all or part of the Services even after a reservation has been confirmed.

Handling of cancellations made at the Company's discretion shall be governed by the Cancellation Policy, the Legal Notice under the Act on Specified Commercial Transactions, the relevant product page, or the information provided at the time of booking.

Photo/video options may not be available due to wind speed, tide levels, equipment safety, or other circumstances.

Article 9 (Conditions of Participation)

Users shall follow the conditions of participation, safety standards, guidance on what to bring and what to wear, and other instructions separately set out by the Company.

Users with pre-existing medical conditions, pregnant Users, Users with concerns about their physical fitness, Users accompanied by infants or young children, and any others for whom the Company requires a safety check shall notify and consult the Company in advance.

The Company may refuse participation in the Services based on a User's health, clothing, equipment, whether they are under the influence of alcohol, their compliance with safety instructions, or other circumstances.

Where a refusal under the preceding paragraph arises from circumstances on the User's side, cancellation fees and related matters shall be handled in accordance with the Cancellation Policy and other applicable provisions.

Article 10 (Prohibited Conduct)

In using the Services, Users shall not engage in any of the following:

  • Conduct that violates laws or public order and morals
  • Conduct that infringes the rights, interests, honor, credit, privacy or other interests of the Company, other Users or third parties
  • Entering or declaring false information
  • Impersonation, duplicate bookings, prank bookings or other improper booking conduct
  • Conduct that obstructs the operation of the Services, unauthorized access, or conduct that places excessive load on the Services
  • Using the Services or Content for sales, resale, redistribution or other commercial purposes without the Company's permission
  • Failing to follow safety instructions, dangerous conduct, or conduct that causes trouble to other participants or guides
  • Conduct involving anti-social forces
  • Any other conduct the Company deems inappropriate

Article 11 (Handling Where an Account Registration Function Exists)

Users shall not allow third parties to use, lend, transfer or share their registration information.

Where registration information changes, Users shall promptly update it through the prescribed method.

The Company shall bear no liability for damage arising from inadequate management of registration information, errors in use, or use by third parties, except in cases of willful misconduct or gross negligence on the part of the Company.

Article 12 (Intellectual Property Rights)

Copyrights, trademark rights and other intellectual property rights in the Content relating to the Site and the Services belong to the Company or the legitimate rights holders.

The timing of delivery, method of delivery or content of the photos/video may change due to natural conditions, equipment conditions, communication conditions or other unavoidable circumstances.

Where a User provides the Company with photos, text, reviews or other information, the Company may use such information for the purposes of operating, promoting, improving and publicizing the Services.

Where the Company uses a User's likeness, name, comments or other personally identifiable information for advertising or promotion, it shall separately obtain the necessary consent.

Article 14 (Changes, Suspension or Termination of the Services)

The Company may change, suspend or terminate all or part of the Services without prior notice to Users in any of the following cases:

  • When performing system maintenance, inspection or updates
  • In the event of natural disasters, fire, power outages, the spread of infectious disease, war, riots, administrative guidance or other force majeure
  • When failures occur in external services, communication lines, payment systems or the like
  • When the Company otherwise judges it necessary for operational or safety reasons

Photos, video, natural scenery, experience content, durations and the like shown on the Site include illustrative images, and the actual content provided may vary depending on weather, sea conditions, season, tide levels and other circumstances.

Article 16 (Limitation of Liability)

The Company shall bear no liability for damage suffered by Users in connection with use of, or inability to use, the Services, except in cases of willful misconduct or gross negligence on the part of the Company.

Even where the Company is liable, the scope of compensation shall be limited to the amount the User paid to the Company for the relevant service; provided, however, that this limitation shall not apply in cases of willful misconduct or gross negligence on the part of the Company.

The Company shall bear no liability for any trouble arising from the use of external sites, social media, payment service providers or other third-party services linked from the Site.

Article 17 (Handling of Personal Information)

The Company shall handle Users' personal information appropriately in accordance with the Privacy Policy separately set out by the Company.

Article 18 (Exclusion of Anti-Social Forces)

Users represent and warrant that they are not, and will not in the future be, a crime syndicate, a member of a crime syndicate, a company affiliated with a crime syndicate, or any other similar anti-social force.

Where a notice is sent to the contact details registered by a User with the Company, such notice shall be deemed to have arrived at the time it would ordinarily arrive.

Article 21 (Severability)

Even if any provision of these Terms, or part thereof, is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Article 22 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

In the event of any dispute between the Company and a User concerning the Services, the court having jurisdiction over the location of the Company's head office shall have exclusive jurisdiction as the court of first instance.

These Terms take effect on August 1, 2026.
